Welcome to Truly Social. By using our services or accessing our website, you agree to the following terms and conditions. Please read them carefully. These Terms & Conditions (“Terms”) are a legally binding agreement between you (“Client,” “you”) and Truly Social (“we,” “us,” or “our”).

1. Services Provided

Truly Social offers social media marketing services, including content creation, social media management, analytics, strategy, and consulting. Specific deliverables, timelines, and responsibilities are outlined in individual client agreements or project scopes. Services may be delivered across platforms including Instagram, Facebook, LinkedIn, and other authorized social media channels.

For local clients, services may include on-site content capture or consultation, as outlined in the client agreement. Any travel, parking, or special equipment costs for on-site work will be billed as outlined in the client agreement.

2. Results Disclaimer

While we strive for strong performance and growth, we do not guarantee specific results. Outcomes depend on factors beyond our control, including platform algorithms, audience behavior, seasonal trends, market shifts, and client participation.

3. Client Responsibilities

Clients agree to:

  • Provide timely feedback, approvals, and communication.

  • Grant administrative access to all necessary social media platforms and related accounts.

  • Supply all required assets (logos, photos, brand guidelines, etc.) promptly. Delays or incomplete materials may affect timelines and deliverables.

  • Ensure all content, materials, and instructions provided are legally compliant and do not infringe on third-party rights.

  • Provide safe and reasonable access for on-site services if required.

  • Cooperate fully to ensure services can be delivered efficiently; delays caused by the client do not waive payment obligations.

4. Ownership of Work

Upon full payment, final deliverables created for you become your intellectual property.

We reserve the right to showcase work in our portfolio, website, or promotional materials unless you submit a written request to opt out.

5. Payment Terms

  • Services are billed monthly based on your selected package.

  • Invoices are issued at the start of each month and are due within 15 days.

  • A 6-month minimum commitment is required to begin services. Monthly billing allows you to spread out the investment while giving us time to deliver meaningful, consistent growth.

  • Late payments may incur a fee of 1.5% per month on outstanding balances.

  • Services may be paused if payment is not received within 15 days after the invoice due date.

  • Truly Social reserves the right to suspend or terminate services for overdue payments.

  • Any travel or on-site expenses will be billed as outlined in the client agreement.

6. Revisions

Each package includes a set number of revisions as specified in your agreement. Additional revisions outside the agreed scope may incur extra charges.

7. Cancellations & Termination

  • A minimum commitment of 6 months is required to start services.

  • After this period, you may cancel by providing 30 days written notice.

  • Work completed through the cancellation date will be invoiced and payable.

  • Truly Social reserves the right to terminate services immediately for breach of terms, nonpayment, or inappropriate conduct.

8. Refund Policy

Refunds are not provided for completed work or partially used service periods, including partial months or content already delivered.

9. Client Platform Access & Social Media Use

You authorize Truly Social to access and manage your social media accounts, including but not limited to Instagram, Facebook, LinkedIn, and other applicable platforms, to deliver agreed services. You are responsible for maintaining the security of your account credentials.

10. Content Approval & Liability

  • Clients must review and approve all content before publishing (if required).

  • Truly Social is not liable for consequences arising from approved content, including legal claims, copyright infringement, or platform penalties.

11. On-Site Content & Media

  • For local clients, Truly Social may capture photos/videos on-site.

  • Clients grant permission for Truly Social to use on-site content in the client’s deliverables and, unless opted out in writing, for portfolio and marketing purposes.

  • Clients must provide safe and reasonable access for on-site services.

12. Third-Party Tools & Services

We may utilize third-party software (e.g., scheduling, analytics, advertising platforms) to provide services. While we choose trusted providers, we are not responsible for failures, outages, or issues caused by these third parties.

13. Amendments by Client or Third Parties

Truly Social is not responsible for performance or content issues resulting from edits, deletions, or interference made by the client or third parties after content delivery or scheduling.

14. Limitation of Liability

Our liability is limited to the amount you have paid for services under this agreement. We are not liable for indirect, incidental, special, or consequential damages.

15. Indemnification

You agree to indemnify and hold Truly Social harmless from any claims, damages, losses, liabilities, or expenses arising from your use of our services, including content you provide or actions on your social media accounts.

16. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, internet or platform outages, government restrictions, illness, or acts of third parties.

17. Dispute Resolution & Governing Law

We strive to resolve disputes amicably through negotiation or mediation. If unresolved, disputes will be settled by binding arbitration in Florida, USA. These Terms are governed by the laws of Florida.

18. Changes to Terms

We may update these Terms from time to time. Any changes will be posted on our website with a revised effective date. Continued use of services after changes indicates acceptance.

19. Confidentiality

All client information, strategies, and content are treated as confidential and will not be disclosed to third parties without prior consent, except as required to provide services or comply with legal obligations.
